Kate Upton Suing Victoria Secret? 'Furious' Model Photo Used Without Consent After Calling Her 'A Footballer's Wife'

Kate Upon is "not thrilled" with Victoria Secret unauthorized use of her photo in their new catalog.

Old images of the Sports Illustrated bombshell were taken in 2011 and used it in the latest catalog after talent booker Sophia Neophitoun bashed the model saying they "would never use her."

Last April, Neophitou told The New York Times , "She's like a Page 3 girl," adding "She's like a footballer's wife, with the too-blond hair and that kind of face that anyone with enough money can go out and buy."

According to the Daily Mail, Upton is very upset, "Kate is not thrilled Victoria's Secret is using these photos. She is not contracted to work with Victoria's Secret and was not notified before the images, taken in 2011, were used," a source told The Daily Mail.

A spokesman for the model explained, "She's not furious, she's just not thrilled about it, and the reason is that she's not contracted to work with Victoria's Secret," a spokesperson told  WWD. "The way it unravelled so quickly left a bad taste in her mouth."

Rumors of the model being a potential angel are swirling, however she's not focused on getting her wings just yet, "As of right now, it's untrue. She has no plans to be a Victoria's Secret Angel," the reps said. "As far as I know, there are no discussions."
