Anna Nicole Smith Manager Howard K. Stern Can Be Retried On Conspiracy Charges

The late Anna Nicole Smith's manager-boyfriend, Howard K. Stern, can possibly be retried on conspiracy charges for obtaining prescription drugs for the famous model, the California Supreme Court ruled Monday (November 3).

The case is being returned to a criminal judge in Los Angeles as Stern is seeking a new trial in the case. However this does not guarantee that the former boyfriend of the Playmate will be retried.

According to Radar Online, Stern conspired with doctors under false names to get drugs for Smith — who was struggling with addiction.

After Smith's tragic 2007 death, Stern and doctors Khristine Eroshevich and Sandeep Kapoor were not charged, however Los Angeles prosecutors charged them with conspiring to give the famous Anna Nicole Smith drugs. Stern was acquitted for most of the 11 counts he faced related to the drugs.

Judge Robert Perry a Los Angeles Superior Court Judge later dismissed the case on terms that it was not unusual for celebrities to use fake names under the terms to protect their privacy.

"We look forward to going before Judge Perry to give him the opportunity to grant our motion for a new trial." Stern's attorney Steve Sadow said.

In the '90s Stern's law firm handled Smith's modeling contracts. Stern met the actress two years after the death of her wealthy much-older husband J. Howard Marshall.

On September 10, 2006 Stern was with Smith when her son Daniel Wayne Smith died while visiting his mother and new born sister. His death was ruled an overdose of antidepressants and methadone.

In 2008 Smith and Stern exchanged wedding vows.
