Reese Witherspoon, well-known actress, was arrested early Friday morning in Atlanta after her husband, talent agent Jim Toth, was arrested for a DUI.
Toth was stopped by a police officer on suspicion of drinking and driving after he was seen weaving in and out of lanes, according to TMZ.
While with her husband, Witherspoon started 'acting up' and asking the cop, "Do you know my name?" When the officer answered that he did not know her name she responded saying, "You're about to find out who I am ... You are going to be on national news," according to TMZ.
"Mrs. Witherspoon began to hang out the window (of her car) and say that she did not believe that I was a real police officer. I told Mrs. Witherspoon to sit on her butt and be quiet," noted police officer J. Pyland in his report, according to TODAY.
"Toth appeared disheveled and his breath smelled of alcohol," according to the police report, says Variety.
Witherspoon received a charge of disorderly conduct after refusing to stay in the car while the police officer gave her husband a sobriety test, TODAY reports.
"Though he told an officer he had only a single drink hours earlier, Toth blew a .139 on a Breathalyzer test administered at the scene," reported Variety. He also faces an additional charge of 'failure to maintain lane.'
When Toth was placed under arrest, Witherspoon got out of the car and was told to get back inside the vehicle. The report says that, "she stated that she was a 'US citizen' and that she was allowed to 'stand on American ground,'" according to Variety.
Witherspoon also resisted arrest, the officer reported, according to Vartiety.
In a statement, Witherspoon said that she is "deeply embarrassed" about this incident and that she "clearly had one drink too many," according to TODAY.
The actress has since said in a statement that she is "deeply embarrassed" about the incident, in which "I clearly had one drink too many."
Witherspoon released a statement saying, "It was definitely a scary situation and I was frightened for my husband, but that was no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I am very sorry for my behavior," according to TMZ.
Both Witherspoon and Toth were released at around 3:30 a.m. Friday morning, according to TODAY. They also have an appearance in court scheduled for 8 a.m. on Monday in Atlanta Municipal Court. Variety said, however, that their attorney is likely to request a postponement of the appearance.
Witherspoon and Toth have been in Atlanta for the filming of an independent film called, "The Good Lie," in which Witherspoon plays a "brash American woman" who develops a friendship with the main character of the film, according to Variety. Shooting of the film was generally unaffected by the arrest.
