KickAss Torrents Up Against US Court; Indictment Against KAT Owner Should Be Dismissed?

KickAss Torrents is ready to take their stand legally against the U.S. Court. Last week the KAT owner and his legal team requested that the charges be dismissed because there is no concrete proof of actual copyright infringement.

The Inquirer reported that the American high technology attorney and computer scientist Ira P. Rothken is siding with KissAss Torrents. Thus, they are in good hands concerning the lawsuits that the KAT owner Artem Vaulin is facing. Vaulin and his defense team are requesting that the charges against him be dismissed.

Last week, Vaulin along with Rothken asked the Illinois District Court that they dismissed the criminal charges against the KissAss Torrets proprietor and set him free. His defense lawyer, Ira Rothken stressed that the torrent files are not copyrighted content. "We believe that the indictment against Artem Vaulin in the KAT torrent files case is defective and should be dismissed. Torrent files are not content files. The reproduction and distribution of torrent files are not a crime," Rothken told Torrent Freak.

The defense compared KissAss Torrents to search engines like Google where users can search for the file they needed. Rothken further explained that when third party users infringe the torrent files it happens after leaving the KickAss Torrents site. Thus, it is not fair that the liability is put on Artem Vaulin's shoulder.

However, US Department of Justice prosecutor Devlin Su does not agree that KickAss Torrents is comparable with Google. Su explained that Google is not devoted to uploading and distributing of copyrighted works.

In addition to this, KissAss Torrents reportedly earned millions of dollars per year. The prosecutors are convinced that KickAss Torrents is a piracy haven with an advertising revenue of about $12.5 million to $22.3 million. Vaulin was denied bail and remains in custody. He is struggling with severe health issues that he had to be transferred to a hospital a few weeks ago.
