Following the unfortunate death of his stepson who became brain dead after a jet ski accident, Usher and ex-wife Tameka Foster are currently involved in a bitter court dispute regarding custody of their two other children, Raymond V (4) and Naviyd Ely (3).

The court refuses to postpone the trial even after the untimely death of Foster's 11-year-old son, Kile Glover. The boy was knocked in the head by a jet ski watercraft on July 6 and was declared brain dead by doctors at a local hospital. Weeks later the family decided to take Glover off of life support, and he passed away on July 21. After Foster and the "U Got it Bad" singer laid Glover to rest in Atlanta on July 27, they found themselves back in family court less than a week later.

The trial is now set to resume on August 13 in Fulton County, GA, where Usher is planned to take the stand. Although Usher wished to reschedule the trial, believing that Glover's sudden death would bring "unnecessary stress and strain" into the courtroom, Foster refused, saying that the hip-hop star was faking grief in order to win over sympathy votes in the custody battle.

According to TMZ, Usher reportedly also feared that the court might rule against him in favor of a grieving mother. In newly-filed court documents, Foster even insists that Usher visited Glover only once while the young boy was in the hospital.

In a statement released to the Global Grind, Foster wrote, "Sadly, I remain in the unfortunate position of having to respond to and attend court proceedings that were not initiated or begun by me. I did not file this custody case (January 2011) and was content with the 'joint custody' arrangement that we share."

She then adds, ""Most importantly, nor do I wish to appear in court while I am mourning the loss of my son. I Have only been defending myself and protecting the best interests of my children through my counsel... My boys are my entire world and I will fight tooth and nail to keep all my sons together as a family."

Foster closes with, "I pray for a swift, peaceful resolution so that we all can move forward."
