Actor Tom Cruise is indeed not a litigious person as once claimed by his lawyer Bert Fields. The actor is reportedly not keen to pursue any legal case against his neighbour who trespassed on his property under the influence of alcohol last Sunday.

According to a TMZ report, The Mission Impossible star has said that he will not press any case against the trespasser who intruded on his Beverly Hills residence over the weekend. Meanwhile, Beverly Hills cops will likely refer the case to the L.A. County D.A.

"Tom's not a vindictive guy. The guy was drunk.  He didn't have a malicious intent," the celebrity site quoted Tom's lawyer, Bert Fields as saying.

The trespasser has been identified as Jason Sullivan, an Australian model and reality star. He allegedly mistook Tom's home for his own and sought to scale the fence to gain entrance.

The security guard at Tom's home had to use his Taser stun gun to stop Jason from further entering into the actor's property.

Jason reportedly climbed the fence and continued to advance towards Tom's house, in spite of several warnings from the security guard. He was attacked with stun gun twice before he was detained.

The cops later arrested Jason for trespassing on private property and he was taken to hospital for treatment as he had suffered a stun gun attack.
