Papa John’s Lawsuit: Annoyed Customers Sue Pizza Chain for Spamming

America's popular pizza major Papa John's likely to land a multi-billion bill for spamming its tens of thousands of customers.

A Seattle Court admitted a class action suit against the pizza chain for bombarding customers with messages marketing its product, without their prior consent. If a judge determines Papa John's guilty of breaching the communication law, the company may be directed to pay monetary compensations to all the annoyed customers.

According to reports, Papa John's in collaboration with OnTime4U, a mass text messaging service provider, has sent at least 500,000 unwanted messages to the customers, available in its data base. Normally, the pizza shops seek phone information of customers in order to alleviate the process of placing order over the phone.

The customers have moved the court saying that their mobile inbox was blasted repeatedly over 10 messages in a row and sometimes they even received text that detailed about the products and deals offered by Papa John's in middle of the night.

The way opted by the pizza company is touted to have violated Telephone Consumer Protection Act of 1991, which restricts the solicitations and directs the companies to get the customers' permission before losing text message on them.  

"The plaintiffs are seeking $500 per text, but they could be awarded up to $1,500 for each message if a jury rules that Papa John's willfully broke the law," reported CNN Money.

"After I ordered from Papa John's, my telephone started beeping with text messages advertising pizza specials. Papa John's never asked permission to send me text message advertisements," Erin Chutich, one of the plaintiffs, said in a statement, according to the website.
