Frontman and vocalist of Metal Band Guns N' Roses, Axl Rose's case against the band's former guitarist, Slash might hit the wall as reports have suggested that it might be thrown out of court.
Judge Charles Palmer told reporters that he has to throw the case out as Rose waited too long to bring it to the notice of the court, Hollywood Reporter reported.
Rose who fell out against his band mate Slash since 1996, had sued the video game maker, Activision for their Guitar Hero III video game that has Slash appearing in the game, as a playable avatar. He even gave advertisements for the game. But according to Rose he had only licensed the song "Welcome To The Jungle" and hence Slash's appearance led to breach of contract from the part of Activision. Though the game was out in 2007, Rose took three years to file the case. He filed a $20 million lawsuit against Activision.
"The reason I did not file a lawsuit is because Activision - through my managers and representatives - offered me a separate video game and other business proposals worth millions of dollars to resolve and settle my claims relating to GHIII. From December 2007 through November 2010, Activision was offering me a Guns N' Roses dedicated video game, a game dedicated to music from the 'Chinese Democracy' album, and other proposals," said Rose in his deposition for the case.
A decision on the lawsuit is expected in the next two weeks, according to Ultimateclassicrock.
