Donald Trump is at it again. It seems like every week Trump is suing someone new. This week it's Angelo Carusone who is feeling the wrath of a $25 million Donald Trump lawsuit.
Trump is suing Carusone after he started an online petition urging Macy's to "Dump Trump" from Macy's stores. The petition was started last year on SignOn.org and has added over 683,000 signatures so far. The petition asks Macy's CEO and President Terry J. Lundgren to stop selling Trump's fragrances and clothing line in Macy's stores. What is the reason for the petition? Well, the petition says it's over "especially unpleasant, nasty and despicable behavior."
Apparently Mr. Trump disagrees. Trump's attorney Alan Garten sent a letter, dated December 27th, to Carusone saying that he will sue him for $25 million if he doesn't stop his campaign to "Dump Trump" from Macy's. Among the allegations in the letter:
"While you claim to be merely exercising or right to free speech, your egregious, pre-meditated and illegal conduct far exceeds anything protected by the Constitution."
The letter goes on to say:
"Rather than simply engage in lawful protest, you have apparently made it your mission to interfere with and intentionally disrupt Mr. Trump's longstanding and well-established business relationship with Macy's as well as his contractual dealings with other third parties through mob-like bullying and coercion."
Despite Trump threatening to sue, Carusone doesn't seem to be fazed. Carusone's attorney, Paul Alan Levy of Public Citizen, responded on January 23rd with a statement. Included in the statement was Levy's take on the First Amendment:
"There is a well-established First Amendment right to advocate a boycott over policy-related objections ... I have no reason to believe that there is a tort of exaggerating the public support for a political campaign. If there were such a tort, I imagine that most candidates for public office, no doubt including your client, would be liable at one point or another."
To his credit, Carusone spoke out in defense of himself without the help of lawyers. Carusone explained that he has dealt with bullies before and he will not back down to Trump. It seems Trump's lawsuit is only further fueling Carusone's attempts to boycott Trump from Macy's.
It's just another week with a Donald Trump lawsuit. Whose side are you on in this lawsuit...Donald Trump or Angelo Carusone?
