One of the latest motions in Lindsay Lohan's reckless driving case filed by her attorney, Mark Heller, is a letter detailing the Mean Girls actress' intend to give "inspirational talks at schools and hospitals." This, and numerous other motions, has come after Los Angeles County Superior Court Judge James Dabney declared that Heller was "incompetent" and not fit to practice law in California. Heller is only licensed in New York.
The other motions to postpone Lohan's trial included many instances of illness and Heller's claim that the actress was not Mirandized before the police started questioning her. Judge Dabney through this motion out since it was not filed during the arraignment. Heller also asked for a trial delay to have more time to prepare a defense and to allow Miss Lohan to undergo "intensive psychotherapy." On top of the therapy, Lindsay would also partake in public service, which would be the motivation speaking part of the story. Heller included all of this in a poorly worded letter to Dabney. The Judge denied all of these postponement requests, saying that what is to come will not "suddenly...change the history of this case." The date of the trial is March18, 2013.
Judge Dabney did not stop there. He took this opportunity to share his opinions on Mark Heller, calling him incompetent and adding that when the trial starts he would need to bring an attorney who "has some experience in California law and procedure." If he does not, Lohan will have to waive her right to procure an attorney that is "competent in California law and procedure." Dabney is clearly not happy with Heller.
The 26-year-old actress/singer was charged with "misdemeanor counts for reckless driving, providing false information to an officer and willfully resisting, obstructing or delaying an officer." She also has a probation violation from when she had stolen a $2,500 necklace from a Venice, California, jewelry store in 2011. According to the "L.A. Times," Lohan can avoid a trial for all of these charges if she agrees to serve "at least 90 days in a lockdown rehabilitation facility."
If Lindsay Lohan was eventually allowed to go around to these schools and hospitals as a motivational speaker, what do you think she'd say? She has clearly made some bad decisions so maybe it would be a long discussion about what not to do. "If you do this, you will ruin a budding career and become the source of countless jokes and gossip." That sounds about right.
