Have you ever questioned whether some of these reality shows are planned out before hand? Well a lawsuit brought forth by a former "Storage Wars" star Dave Hester was alleging just that. Hester brought forth a lawsuit against A&E's "Storage Wars" back in December accusing the show of being staged and alleging he was wrongfully terminated. On Tuesday, Los Angeles Superior Court Judge Michael Johnson sided with the network.
Hester filed the lawsuit back in December when he claimed he was fired after complaining that the show was staged. Hester also claimed A&E took part in unfair business practices when producers of the show made him look less skillful than he actually is. Judge Michael Johnson threw out the unfair business practices part of Hester's lawsuit on First Amendment grounds. Johnson sided with A&E that an injunction against the show would violate its First Amendment rights. Johnson explained, "It is well settled that television broadcast involves free speech, as well as production activities that advance or assist in the creation of a television program."
Ultimately the lawsuit and court case gets into a lot of legal mumbo jumbo involving First Amendment rights and lawyer talk. For reality show fans and viewers of "Storage Wars" the big accusation is that the show is staged. Hester is alleging that producers of the show plant items in the storage lockers. The show makes it seem like people are bidding on these storage lockers without knowing what is inside of them. If producers are placing items in the lockers that is kind of shady. It would be even worse if some of the people bidding already knew what was inside. However, that is just a guess on my part.
Hester's lawsuit also includes claims of breach of contract and breach of implied covenant of good faith and fair dealing. These items haven't been addressed yet.
