Chicago resident Anishi Spencer is suing McDonalds over claims that her son found and ate a used condom at one of the fast food giant's playplaces.
Spencer claims that her sons Jaquel and Jonathan Hines found the used condom on the floor of the kid's area during a visit in February of last year. She claims that the incident came to her attention when Jaquel later coughed up a piece of the condom. Both children required medical attention.
The suit, which was filed Wednesday at the Cook County Circuit Court, accuses McDonalds of negligence for failing to properly clean hazardous materials from the area. The suit also blames McDonalds Corp and McDonalds of Illinois for not preventing the initial "deviant activities" that led to the used condom being on the floor, via surveillance or personal inspection.
The premises liability suit charges the fast food company with three counts of negligence and asks for $50,000 in damages, as well as compensation for the Hines' medical treatment.
