A trademark court battle between the "Kylies" has finally come to an end. US reality TV star Kylie Jenner has lost a legal battle to Australian singer Kylie Minogue over her bid to trademark their shared first name.
The 19-year-old reality star, who is well-known for her appearances on "Keeping Up With The Kardashians" and is Kim Kardashian's half-sister, had filed the papers to trademark her first name "Kylie" in the US in 2014, reports Mail Online. Her move was opposed by the "Can't Get You Out of My Head" singer Kylie Minogue who apparently sent a list of reasons to the US Patent and Trademark Office justifying why the request for trademark should be rejected.
The documents submitted by KDB, an Australian-based business representing Minogue, referred to Kylie Jenner as "a secondary reality television personality" whereas Minogue was called an "internationally-renowned performing artist, humanitarian and breast cancer activist know worldwide simply as 'Kylie'," as reported by BBC.
Minogue, 48, who has been performing as "Kylie" since before Jenner was born and owns a website with the same name since 1996, claimed that approval of the trademark will confuse audiences and possibly damage her brand name. She already owns the trademarks for "Kylie Minogue Darling," and "Lucky: The Kylie Minogue Musical."
Kylie Jenner's trademark application which sought to register the term "Kylie" for advertising services and endorsement services in the US was rejected by the Patent Office last week. The rejection didn't go well with Jenner who has already filed an appeal.
It was last week only that Minogue had announced her split from fiancé, British actor Joshua Sasse, over his alleged closeness to Spanish actress Marta Milans. This legal win against Jenner will act as a breath of fresh air for Minogue. While Minogue is emotionally drenched these days, Kylie Jenner, on the other hand, is busy posing and getting measured for her wax figure.
