Stand up comedian and former star of SNL and 30 Rock, Tracy Morgan, is still fighting to recover from a 'traumatic brain injury' and associate other injuries sustained in a horrific fatal car crash in June, and is "just not better" his lawyer said today.

Morgan's lawyer Benedict Morelli announced in court that in the June 7 crash on the New Jersey Turnpike the comedian "suffered a traumatic brain injury in addition to a broken leg, nose and ribs," say The Hollywood Reporter

They also report that Morelli told the court that Morgan is "fighting to get better, and if there's a chance for him to be back to the Tracy Morgan he once was, he's going to try to do that." But due to the severity of Morgan's injuries, they don't yet know just how the star will recuperate and recover.

According to ABC Morelli told AP that "When you have a traumatic brain injury it takes a very long time to find out how you're going to do and how much you're going to recover. You just don't know."

"So that's where he is. He's still fighting and trying to live his life at the same time and trying to get better, and he's just not better. We're hoping and praying to get him back to where he was. But the jury's out."

According to Morelli, reports Businessweek, Morgan was able to leave rehab on July 10, and "undergoes cognitive, physical and speech therapy five days a week".

Morelli was in court as Morgan is suing Wal-Mart for punitive and compensatory damages after the crash, which killed comedian James McNair and left three injured, two in a critical condition, as Morgan was heading back to NYC from a show in Delaware.

One of those in critical condition, Ardie Fuqua Jr, posted a photo montage from the Delaware show.

Wal-Mart are defending themselves by saying that the victims of the crash weren't wearing seat belts, but declined to comment after the lawyers for both sides met today to work out a schedule. The driver of the truck, Kevin Roper, has plead not guilty

Morgan was due to start a new show for FX, but as reported by The Huffington Post, "FX Networks issued a statement saying Morgan's new TV series, a half-hour comedy scheduled to start filming in August for a January premiere on the FXX network, would be waiting for him once he's well."
